Terms and Conditions


These Terms and Conditions (“Agreement”), in conjunction with the specific terms of each purchase, constitutes a legally binding contract between Collegiate Transport, LLC and Customer.

The general terms and conditions under which Collegiate Transport, LLC operates, includes pick-up, storage and return delivery of Customer’s personal belongings. Collegiate Transport, LLC only provides these services to students in campus dormitories. Currently, Collegiate Transport does not provide this service to students in apartments.  Therefore, we do not store furniture.  The right to amend any portion of this agreement, and/or any other portion of these services provided, is fully reserved by Collegiate Transport, LLC at all times.

Services

Collegiate Transport, LLC requires that the Customer agrees to be present for the (1) delivery of packing kit, (2) pick-up of boxes, and (3) return delivery of boxes.  The Customer agrees to abide by provisions made solely by Collegiate Transport, LLC.  You must be 18 years of age or older before submitting personal information.  You are solely responsible for maintaining and protecting your account login information. Collegiate Transport, LLC will determine the delivery date of the packing kit, the pick-up date of boxes during move-out week and the return delivery date.  Collegiate Transport, LLC solely and fully reserves the right to store the boxes at an appropriate storage facility of its choice.  The Customer agrees that he/she will not have access to his/her boxes while in the possession of Collegiate Transport, LLC.

Supplies

With a paid order, Collegiate Transport, LLC provides a free packing kit of five (5) 24x18x18 boxes for the Basic package, ten (10) 24x18x18 boxes for the Collegiate package, ten (10) 24x18x18 boxes for the Study Abroad package and fifteen (15) 24x18x18 boxes for Scholarship Package.  The Scholarship package must be used in four (4) consecutive years.  All supplies are delivered by Collegiate Transport, LLC to the Customer.  The maximum weight of each box should not exceed 65 pounds.  The Customer must be present during delivery of supplies.  If the Customer is not present, a Collegiate Transport, LLC representative will leave the supplies at the door of the Customer or in the mail room of the building.  Collegiate Transport, LLC will notify the Customer of the actions taken.

Pick-Up

The Customer must be present for the pick-up of the boxes during move out week.  Pick-up of the boxes from the Customer will take place either at the door of the Customer’s room or at the entrance of the Customer’s building/dormitory, as determined by residency and/or university rules.  The Customer understands that the boxes will be delivered one week prior to the scheduled move-out week.  That same week, the pick-up date and time will be sent via e-mail and phone message.  The Customer agrees to be present, unless agreed upon in writing five (5) days before the pickup date.  If a different move-out date is requested, an additional $150 charge will apply.

Return Delivery

Collegiate Transport, LLC will return delivery of the boxes to the Customer on a scheduled move-in date.  If a different move-in date is requested, an additional $150 charge will apply.  At the discretion of Collegiate Transport, LLC, depending on residency and/or university rules, the boxes may be delivered to the Customer’s room.  The Customer understands that he/she may have to retrieve his/her boxes from a common area.  The Customer agrees to sign for the receipt of the boxes at which time Collegiate Transport, LLC liability ceases.  Collegiate Transport, LLC is not liable for any damage of the boxes and/or the Customer’s belongings prior to pick-up or after delivery.  The Customer agrees that any damage to the boxes must be noted at this time.  The Customer must be present to do so.  If the Customer is not present, signature of a Collegiate Transport, LLC representative will be evidence that the boxes were delivered in good condition.  Only damage to the exterior of the boxes will be grounds to initiate an insurance claim as described in the Insurance section of this document.

Service Guarantee

If Collegiate Transport, LLC fails to comply with the terms of this Agreement, Collegiate Transport, LLC will issue a full credit to the Customer.  Collegiate Transport, LLC will issue a full credit only if Customer has fully complied with the terms of the Agreement, not tampered with or removed any label(s) from the boxes.  Otherwise, Collegiate Transport, LLC will issue a credit to the Customer in an amount determined by its sole discretion.  Force Majeure: This section does not apply to situations outside the control of Collegiate Transport, LLC, including, but not limited to, acts of God (such as fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, foreign enemy action, hostilities, civil unrest, military coup, terrorist activities, government sanction, blockage, embargo, labor dispute, strike, lockout, electrical failure, telephone service disruption, or ground transportation service disruption.

Restrictions on Boxes

Collegiate Transport, LLC may refuse, open, or inspect any box for any reason.  The Customer will not submit collective boxes with a value of more than $500.  The Customer will not submit any boxes containing hazardous materials, firearms, items that are prohibited by any law or regulation of any federal, state, or local government of the United States, cash, any type of monetary item, jewelry, and/or collectibles, food or perishable items, liquid, or any item expressly prohibited on www.collegiatetransport.com.  The Customer is responsible for ensuring that boxes are safely and securely packed in order to withstand shock, compression, vibration and other movements of normal transportation.  Collegiate Transport, LLC assumes no liability for damage due to poorly packed boxes.  The Customer is liable for any damage or loss arising from Customer’s failure to adhere to the aforementioned restricted items.

Payment

At the time of purchase, Customer will pay invoice in full, via a valid credit card or PayPal account in accordance with the payment terms indicated on the receipt of purchase.  The Customer understands that he/she remains indebted to Collegiate Transport, LLC for any rejected/invalid form of payment or for any other reasons that causes Collegiate Transport, LLC not to receive monies owed.  Collegiate Transport, LLC may charge Customer’s credit card or PayPal account for any outstanding fees before delivery of Customer’s belongings.  Collegiate Transport, LLC is not bound to any scheduled pick-up, storage, or return delivery for a Customer with an outstanding balance.  Prices are found on www.collegiatetransport.com and are subject to change without notice.

Insurance Coverage

Collegiate Transport, LLC protects/insures all boxes in the case of loss or damage automatically for up to one hundred dollars ($100 USD).  The customer acknowledges that no single box has a value of more than one hundred dollars ($100 USD) and that Collegiate Transport, LLC is not liable to pay any single Customer more than five hundred dollars ($500 USD).  The value recorded by the Customer must not exceed one hundred dollars ($100 USD) per box.  The Customer agrees that the actual value of the boxes is less than or equal to the recorded value.  The amount that each item is insured is equal to the total insurance amount divided by the number of items.  All items stored will be insured for the same amount of money.  The Customer agrees to assume all risk of loss or damage.  Collegiate Transport, LLC and Collegiate Transport, LLC’s agents, affiliates, authorized representatives and employees are not responsible for any loss, liability, claim, expense, damage to property or injury to persons that could have been insured but was not (including without limitation any loss arising from the active or passive acts, omission or negligence of Collegiate Transport, LLC or its agents, affiliates, authorized representatives and employees).

Insurance does not cover damage or loss to the following types of items:
•             cash or any other monetary item
•             jewelry
•             fragile items (e.g. mirrors)
•             electronic equipment/small appliances with no evidence of physical damage
•             unpacked items
•             items whose primary value is personal or sentimental
Insurance does not cover damage or loss existing prior to pick-up or caused after return delivery, for which there is no visible evidence of physical damage, arising during normal handling or transportation, damage that is concealed caused by poor or inadequately packed items or caused by forces outside of Collegiate Transport, LLC control.  As previously mentioned, items must have physical damage to the exterior of the packaging.  All insurance coverage is limited to the period in which the Customer’s possessions are in the custody of Collegiate Transport, LLC beginning after pickup and ending after delivery as described above.

Customer Claims for Lost or Damaged Parcels

Before making an insurance claim with Collegiate Transport, LLC Customer must exhaust any applicable personal insurance policies.  If a claim is to be made, the damaged package must be inspected by and in the presence of a Collegiate Transport, LLC representative at the time of delivery to confirm any claims.  The box must be opened at that time for the Collegiate Transport, LLC representative to assess and document the damage.  The Customer must notify the Collegiate Transport, LLC representative at the time of delivery if a box is lost and sign the proper documents (claim form).  Missing items must be handled in a similar manner.  If the Customer is not present, a Collegiate Transport, LLC representative will determine if there is any damage or loss.  If no claim is made at the time of return delivery, it shall be determined that there is no claim present and any claim after that time will not be honored.  Collegiate Transport, LLC will process any legitimate claim within thirty (30) days of receipt.  Collegiate Transport, LLC will pay the lesser of the following: a) cost of restoring the item, (b) replacing the item, or (c) the amount of insurance on the package ($100 USD). Collegiate Transport, LLC shall have no liability for any claim payment that is denied by the Customer.

Abandonment

The Customer agrees to pay Collegiate Transport, LLC any fees that it incurs with the removal (shipping to the permanent address provided by the Customer) or disposal of any abandoned items.

Cancellation Policy

Cancellation fee is ($350 USD) for Scholarship Package
Refunds are calculated as purchase price less first year storage plus cancellation fee.
Purchase Price                               $999
Storage plus Cancellation Fee      – $729 ($379 + 350)
Refund                                         = $270
NO REFUNDS will be issued after second year of storage.
Refunds will be issued within thirty (30) days of the cancellation date.

Waiver of Liability

Customer waives all claims against Collegiate Transport, LLC for any loss, liability, claim, expense, and damage to property, or injury to persons in excess of the amounts for which boxes are insured by Collegiate Transport, LLC.
Customer waives all claims against Collegiate Transport, LLC for any loss, damage, or injury that was not or could not be insured against, including, but not limited to, any loss arising from the active or passive acts, omissions, or negligence of Collegiate Transport, LLC. Customer waives all claims against Collegiate Transport, LLC for any costs associated with any claim arising from this Agreement.

Applicable Law

This Agreement shall be governed by the laws of the State of Georgia.
Any court action pertaining to this Agreement shall be conducted in the courts of the State of Georgia.

Amendments

No individual, including but not limited to, representatives, employees and affiliates of Collegiate Transport, LLC or its agents, is authorized to make any representations, warranties or agreements other than as expressly set forth in this Agreement.  Customer may not change this Agreement except by submitting prior Written Notice and receiving written confirmation from Collegiate Transport, LLC clearly stating that Collegiate Transport, LLC has accepted the request.  Collegiate Transport, LLC may amend this Agreement at any time.

Entire Agreement

The Customer acknowledges that there are no representations, warranties, or Agreements by or between the parties which are not fully set forth herein.  No individual inclusive of representatives of Collegiate Transport, LLC or Collegiate Transport, LLC’s agents is authorized to make any representations, warranties, or Agreements other than as expressly set forth herein.  This Agreement may only be amended by a writing signed by both parties prior to initiating the transaction.

Severability

If any provision of this Agreement is determined to be invalid or unenforceable, in whole or in part, the other provisions of this Agreement shall be unaffected and shall remain in force and effect to the fullest extent permitted by law.
